Offer Terms & Conditions

This limited period promotional offer ("Offer") is provided to you by Amazon Pay (India) Private Limited ("Amazon") and made available at the Eligible Stores (defined below) by Shoppers Stop Limited, having its registered office at Umang Towers, 5th Floor, Off Link Road, Behind Inorbit Mall, Malad (West), Mumbai – 400 064 ("Shoppers Stop").

You agree that, by participating in or availing this Offer, you will be bound by these terms and conditions ("Offer Terms"). These Offer Terms are in addition to the Terms and Conditions of Amazon Pay Balance: Money Wallet available at https://www.amazon.in/gp/help/customer/display.html?nodeId=202123460 which apply to your use of use of 'Amazon Pay Balance: Money' ("Amazon Pay Balance"). To the extent the Terms and Conditions of Amazon Pay Balance: Money Wallet are inconsistent with these Offer Terms, these Offer Terms shall prevail with respect to the Offer only.

The Offer is valid from November 3, 2018 to January 31, 2019 (both days included) ("Offer Period"), unless revoked or extended by Amazon in its sole discretion, without any reason or prior notice and without liability.

Except for the stores located in the airports, this Offer is available at all "Shoppers Stop" and "Homestop" offline retail stores located in India which accepts payments through the "Scan & Pay" functionality pertaining to Amazon Pay Balance available on Amazon.in mobile application (such stores hereinafter referred to as "Eligible Store" and such pay functionality as "Eligible Payment Method").

During the Offer Period, any customer who undertakes a purchase transaction with respect to an order placed at the Eligible Store and pays for such transaction using the Eligible Payment Method shall be eligible to receive Benefit (defined below) under this Offer once per calendar month. Such transaction is hereinafter referred to as "Qualifying Transaction".

Subject to these Offer Terms, any customer who satisfies the criteria mentioned in Section 5 above (each such customer referred to as "Eligible Customer") will be eligible to receive a cashback of: 
(a) 15% of the total value of the Qualifying Transaction (subject to a maximum cashback of INR 750) if such Eligible Customer is an Amazon Prime member during the Offer Period; and 
(b) 10% of the total value of the Qualifying Transaction (subject to a maximum cashback of INR 500) if such Eligible Customer do not hold Amazon Prime membership during the Offer Period. 
Such cashback is hereinafter referred to as "Benefit". Further, the Amazon Prime members may be subject to additional legal terms and conditions related to the Amazon Prime program.

The Benefit will be provided to the Eligible Customers in the form of Amazon Gift Card(s) (issued by QwikCilver Solutions Private Limited) which will be credited to the Amazon Pay Balance account of each Eligible Customer within 72 hours of each Qualifying Transaction. The Amazon Gift Card(s) are redeemable as Amazon Pay Balance and are subject to the terms and conditions available here.

It is clarified that for a transaction to be considered a Qualifying Transaction, the entire payment against an order at Eligible Stores must be made through the Eligible Payment Method. Customers making payments for the transaction using a mode of payment other than the Eligible Payment Method, or multiple payment methods (in addition to the Eligible Payment Method), will not eligible to receive the Benefit under this Offer.

Amazon reserves the right to add, alter, modify, change or vary any or all of these Offer Terms at any time, without prior notice and without liability, and without assigning any reason whatsoever, or to replace (wholly or in part) this Offer by another offer, whether similar to this Offer or not.

A customer will not be eligible to receive the Benefit, if the Qualifying Transaction order is cancelled by either the Eligible Customer or the merchant at the Eligible Stores, or if the Eligible Customer cancels or revokes the payment made through the Eligible Payment Method. Such cancellation or return or revocation may be for any reason whatsoever. In such cases, the participation of the Eligible Customer in the Offer will be deemed withdrawn.

Under no circumstances, will the Benefits under this Offer be settled in cash in lieu thereof by Amazon or Shoppers Stop. You agree that all decisions of Amazon related to the Offer will final and binding on you. Failure by Amazon to enforce any of these Offer Terms, in any instance, will not be deemed to be a waiver of the Offer Terms and will not give rise to any claim by any person.

By participating in this Offer, you expressly agree that Amazon or Shoppers Stop or any of their respective affiliates will not be liable or responsible for any loss or damage whatsoever that you may suffer, directly or indirectly, in connection with this Offer, including but not limited to those associated with its delivery or use or misuse of the product(s), verification, redemption and/or any other matter in relation to the discounts or any issue(s) connected with making the Qualifying Transaction or the inability to make a transaction for any reason whatsoever.

Any query, in relation to the Offer or the Benefit, can be asked by submitting a request through https://amazonpay.amazon.in/jr/your-account/contact_us. Such queries will be entertained only up to February 28, 2019.

This Offer is governed by the laws of India and any disputes arising out of or in connection with this Offer will be subject to the exclusive jurisdiction of the courts at Bangalore.

Any customer is not bound in any manner to participate in the Offer. Any such participation is voluntary. This Offer is being made purely on a "best effort basis".
